Ihedioha’s Supreme Court application for judgment review adjourned till March 2

Nigerian Supreme Court, on Tuesday adjourned hearing of the Peoples Democratic Party (PDP) and Emeka Ihedioha’s application seeking the review of the January 14, 2020 judgment which sacked him as Imo State governor and installed Hope Uzodinma as his replacement.

Hearing in the appeal could not go on as scheduled by the court following a request by Ihedioha’s lead counsel, Chief Kanu Agabi SAN, for a short adjournment to enable him respond to a process served on him the previous day by the respondents.

The Supreme Court says the new date to hear the application for a review of judgment is now March 2, 2020.

Independent National Electoral Commission (INEC) had last March declared Ihedioha as winner of the March 9 governorship election having won majority of lawful votes cast at the governorship poll.

Similarly, the Imo State Governorship Election Petition Tribunal and the Court of Appeal in their concurrent decisions in the appeal filed by Senator Uzodinma, upheld Ihedioha’s election and dismissed the petition on grounds that Uzodinma did not prove his allegations against the election of Ihedioha.

Ihedioha and his party are asking the court to reverse the judgment which declared Hope Uzodinma of the All Progressives Congress, APC, winner of the 2019 governorship election.

At the mention of the case on Tuesday, Ihedioha’s lead lawyer, Kanu Agabi sought for time to enable parties file the necessary papers, a request other lawyers in the case did not oppose.

Chief Justice of Nigeria (CJN), Justice Ibrahim Muhammad, who led other six justices, in a brief ruling, granted the request for adjournment and adjourned till March 2, 2020.
