Impeachment: Court orders Ekiti Assembly, Clerk and Adelugba to file their defence

A High Court of Ekiti State on Wednesday morning asked the Ekiti State House of Assembly, the Clerk and Hon Olubunmi Adelugba, the defendant /respondents in the suit challenging the impeachment of Rt Hon. Olugboyega Aribisogan as Speaker of Ekiti State House of Assembly to file their defense in the matter and stop waisting the precious time of the court.
The presiding judge, Justice Kunle Adeleye during the resumed hearing of the matter in Ado Ekiti on Wednesday morning told the Counsel to the Defendant/respondents, Mr R. O Balogun that the fourteen days required by law to file their defense had lapsed and that the preliminary objection brought by him was diversionary and an attempt to prolong the matter.
In his ruling, he ordered the defendants/respondents to file their defense in time to enable the court to determine the matter. He also ruled that the Preliminary Objection brought by the defendants would be heard together because the matter before the court is an Origination Summon which requires that a counter affidavit be filed within the stipulated time.
The Court also ruled that whatever arguments the Defendant/respondents have on the matter should be brought along with the Counter affidavit on or before February 1, 2023 when the court shall sit on the matter.
The judge also reiterated his earlier stand on expeditious and timeous disposition of the case adding that he would not tolerate frivolous motions and counter motions.
Speaking at the Court premises this morning, the embattled Speaker, Rt Hon Olugboyega Aribisogan said that he’s waiting patiently for justice to prevail.
“I’m a non-violent crusader for justice and a believer in the rule of law and not the rule of the gun. I know victory is certain and that justice will prevail at the end.
